Question: If a product has a design patent only in US, can someone get suited if the very same design is being
immitated and sold in countries outside US?
Answer: I am not sure what you mean by getting suited outside the US. If what you are asking is whether a design
patent in the US gives an inventor rights in another country, the answer is no. A US patent only give an inventor rights
in the US. The only way that you may have rights outside the US is if the product is made or exported from the US.
I am not qualified to answer any intellectual property law questions dealing with other countries laws. There may be
alternative causes of action in other countries. Therefore, if you feel that someone has immitated your invention in
another country, you should consult with an attorney from that country.
